Thus far, all of the anti-Sharia laws have not passed appellate muster. Courts encourage all forms of mediation to relieve the pressure on their dockets. How can Beit Dins be encouraged when Muslim mediation is discouraged? How can any law be made outlawing Kashrut, and by extension, Halal? It can’t be done constitutionally.

San Francisco is considering a ballot initiative to ban circumcision.

If it passes, then it goes to appeals. It can’t win. I’d be surprised if it even passed San Francisco.

This article again underscores the danger of supporting the circumscription or curtailing of one group’s rights while hoping to defend those of another. Actions can be made illegal; not beliefs. I have no problem with a dispute being submitted to a sharia’a court for mediation, so long as the recommended settlement is legal under US law. The logical extension of the “anti-sharia’a” movement’s endeavours is to identify and remove from US law any codes and provisions that mirror sharia’a (death penalty for murder, etc.). That should be interesting.
